Terms of Service

The agreement between you and Nasugn Pty Ltd for using Nasugn Vigil.

1. About these terms

These terms govern your use of the Nasugn Vigil cloud CCTV service, web console, API and mobile app (the "Service"), operated by Nasugn Pty Ltd (ABN 23 699 435 366), Melbourne, Australia. By creating an account or using the Service you agree to these terms. If you're using Vigil on behalf of an organisation, you agree on its behalf.

2. Your account

You sign in with a passwordless email link or code. Keep access to your email secure — anyone with it can access your account. You're responsible for activity under your account and for keeping your details accurate.

3. Acceptable & lawful use

You may use Vigil only for lawful surveillance of premises you own or are authorised to monitor. You are solely responsible for operating your cameras and recordings in compliance with all applicable laws — including surveillance-device, listening-device, workplace-surveillance and privacy laws in your jurisdiction (e.g. providing required notice/signage, and audio-recording rules). You must not use Vigil to harass, stalk or unlawfully monitor any person, to infringe others' rights, or to attempt to breach the Service's security.

4. Your footage and content

You retain all rights to the footage and content you capture and upload. You grant us the limited licence needed to host, process and deliver it back to you and to provide the Service (including detection and alerts). We do not sell it or use it to train facial-recognition or profiling products.

5. Subscriptions & billing

Standard plans are billed per camera (see current pricing in the console). Fees are in AUD and, where applicable, exclusive of GST. Subscriptions renew until cancelled; you can cancel or manage billing from the console. Except where required by the Australian Consumer Law, fees already paid are non-refundable.

Enterprise plans are quoted per rollout and billed under a separate written order form — typically against an invoice or purchase order on annual terms rather than by card, and not cancellable from the console. Where that order form conflicts with this clause, the order form prevails.

6. The on-site agent

The Service relies on the Vigil Agent running on an always-on machine on your network. If the agent is offline, your cameras won't stream, record or alert. Keeping it running is your responsibility; we'll help you diagnose issues.

7. Availability

Except where a written service-level agreement applies to your Enterprise plan, we work to keep Vigil reliable but don't guarantee uninterrupted or error-free operation. The Service may occasionally be unavailable for maintenance or reasons beyond our control.

8. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we're permitted to limit our liability, our liability is limited to re-supplying the Service or the cost of doing so.

9. Liability

To the extent permitted by law, Vigil is provided "as is". We are not liable for indirect or consequential loss, or for loss arising from your cameras, network, the agent being offline, or your use of footage. Vigil is a tool to help you monitor premises — it is not a guaranteed security outcome or an emergency service.

10. Suspension & termination

You can stop using Vigil and delete your account at any time. We may suspend or terminate access for breach of these terms or non-payment. On termination your data is deleted or exported as described in our Privacy Policy.

11. Changes

We may update these terms as the Service evolves; we'll update the date above and, for material changes, notify you. Continued use after changes means you accept them.

12. Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the courts of that jurisdiction.
